By accessing or using Plan Bop (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

We reserve the right to modify these Terms at any time. Your continued use of the Service following any changes constitutes acceptance of those changes.

2. Description of Service

Plan Bop is a collaborative trip planning and activity discovery platform powered by artificial intelligence. The Service enables users to:

• Plan group trips and activities
• Receive personalized recommendations through our AI assistant, Poppy
• Collaborate with friends and groups on travel planning
• Discover and book activities, accommodations, and experiences
• Manage trip logistics and expenses

3. User Accounts and Registration

3.1 Account Creation

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account.

3.3 Age Requirements

You must be at least 13 years of age to use the Service. If you are between 13 and 18, you represent that you have your parent's or legal guardian's permission to use the Service.

4. User Content and Conduct

4.1 User Content

You retain ownership of any content you submit to the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, modify, adapt, publish, and display such content in connection with the Service.

4.2 Prohibited Conduct

You agree not to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others, including intellectual property rights
• Submit false, misleading, or fraudulent information
• Harass, abuse, threaten, intimidate, or harm other users
• Engage in hate speech, discrimination, or promotion of violence
• Post, transmit, or share sexually explicit, obscene, or offensive content
• Bully, stalk, or engage in any form of targeted harassment
• Share personal information of others without their consent
• Impersonate any person or entity or misrepresent your affiliation
• Distribute spam, malware, or other harmful code
• Attempt to gain unauthorized access to the Service or other users' accounts
• Interfere with or disrupt the Service or servers
• Use automated systems (bots, scrapers) without authorization
• Engage in commercial solicitation or advertising without our permission
• Encourage or facilitate any violations of these Terms

4.3 Chat and Communication Standards

Plan Bop facilitates group communication and collaboration. When participating in group chats, planning sessions, or any communications within the Service, you must:

• Treat all users with respect and courtesy
• Maintain a safe, inclusive, and welcoming environment
• Communicate in good faith and avoid disruptive behavior
• Respect the boundaries and preferences of other group members
• Report any violations of these standards to us immediately

Prohibited behavior in chats and communications includes, but is not limited to:

• Harassment, bullying, or persistent unwanted contact
• Discriminatory, hateful, or derogatory language based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic
• Sexual harassment, unwanted sexual advances, or explicit content
• Threats of violence or harm to individuals or groups
• Doxing or sharing private information without consent
• Trolling, inflammatory comments, or deliberate provocation
• Spam, promotional content, or off-topic disruption
• Coordinated attacks or brigading against other users
• Impersonation or deceptive misrepresentation

4.4 Content Monitoring and Moderation

While we are not obligated to monitor User Content or communications, we reserve the right to review, monitor, and moderate any content, messages, or communications within the Service. We may use automated tools, AI systems, and manual review to detect violations of these Terms. We may remove, edit, or block any content that violates these Terms without prior notice.

5. Data Collection and Usage

5.1 Personal Information

We collect and store information about your use of the Service, including your preferences, past trips, searches, and interactions. This information is used to provide personalized recommendations and improve your experience.

5.2 Aggregated Data

You acknowledge and agree that we may create non-identifiable, aggregated data sets from your usage of the Service. We retain all rights to use, license, sell, or otherwise monetize such aggregated data without restriction. This aggregated data:

• Does not contain personally identifiable information
• Cannot be traced back to individual users
• May be shared with or sold to third parties for commercial purposes
• Helps us sustain and improve the Service

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

6. Intellectual Property Rights

6.1 Our Intellectual Property

The Service, including its design, functionality, software, text, images, and other content (excluding User Content), is owned by Plan Bop and protected by copyright, trademark, patent, and other intellectual property laws.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes, subject to these Terms.

7. Third-Party Services and Bookings

7.1 Third-Party Providers

The Service may facilitate bookings or transactions with third-party providers (hotels, airlines, activity operators, etc.). We act solely as an intermediary and are not responsible for the actions, products, or services of these third parties.

7.2 Third-Party Terms

Your use of third-party services is subject to their respective terms and conditions. You are responsible for reviewing and complying with such terms.

7.3 Payment and Refunds

All payments for bookings are processed by third-party payment providers. Refund policies are determined by the respective service providers, not by Plan Bop.

8. AI Assistant Disclaimers

8.1 Recommendations

Poppy, our AI assistant, provides recommendations based on available data and algorithms. These recommendations are suggestions only and should not be considered professional advice. We do not guarantee the accuracy, completeness, or suitability of any recommendations.

8.2 User Discretion

You are solely responsible for evaluating and making decisions about travel plans, bookings, and activities. Always conduct your own research and exercise reasonable judgment.

9. Fees and Payments

9.1 Service Fees

The Service may be offered for free or on a subscription basis. We reserve the right to change our pricing structure at any time with reasonable notice.

9.2 Beta Access

During the beta period, access to the Service may be free or subject to special terms. Beta features are provided "as is" without warranties, and we may modify or discontinue beta features at any time.

10. Disclaimers and Limitation of Liability

10.1 Service "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10.2 No Warranty

We do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free
• The results obtained from using the Service will be accurate or reliable
• Any errors in the Service will be corrected
• The Service will meet your requirements or expectations

10.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLAN BOP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) $100 USD OR (B) THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Plan Bop, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of another party.

12. Termination and Account Suspension

12.1 Termination by You

You may terminate your account at any time by contacting us at support@planbop.com or using account deletion features in the Service.

12.2 Termination and Suspension by Us

We reserve the right to suspend, restrict, or terminate your access to the Service at any time, for any reason or no reason, with or without prior notice or warning. This includes, but is not limited to:

• Violations of these Terms of Service or our policies
• Prohibited conduct, including harassment, hate speech, or abusive behavior in chats or communications
• Fraudulent activity or misuse of the Service
• Reports or complaints from other users
• Repeated warnings or previous suspensions
• Legal or regulatory requirements
• Security concerns or threats to the Service or other users
• Any conduct we determine, in our sole discretion, to be harmful, inappropriate, or inconsistent with the spirit of the Service

12.3 Permanent Bans

For serious violations, including but not limited to harassment, threats, hate speech, or repeated violations of these Terms, we may permanently ban your account and block your access to the Service. Permanent bans may also include:

• Prohibition from creating new accounts
• Blocking of associated email addresses, phone numbers, or devices
• Removal from all group chats and planning sessions
• Forfeiture of any subscription fees or credits without refund

We are under no obligation to provide reasons for termination or suspension decisions, though we may choose to do so at our discretion.

12.4 Appeals

If you believe your account was terminated or suspended in error, you may submit an appeal to appeals@planbop.com within 30 days of the action. We will review appeals in good faith but are not obligated to reinstate any account.

12.5 Effect of Termination

Upon termination or suspension, your right to use the Service will immediately cease. We may delete your account data in accordance with our data retention policies. You remain liable for any obligations incurred prior to termination. Provisions that by their nature should survive termination (including indemnification, disclaimers, and limitations of liability) shall survive.

13. Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to conflict of law principles.

13.2 Arbitration

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, rather than in court, except that you may assert claims in small claims court if your claims qualify.

13.3 Class Action Waiver

You agree that any arbitration or proceeding shall be limited to the dispute between you and Plan Bop individually. You waive any right to participate in a class action lawsuit or class-wide arbitration.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Plan Bop regarding the Service.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

14.4 Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms without restriction.
